DFS by DreamGRC - Digital Forensics as a Service

1. Acceptance of Terms
By accessing or using the DFS by DreamGRC platform ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions, you may not access or use the Service.
2. Description of Service
DFS by DreamGRC provides digital forensics analysis as a cloud-based service, including but not limited to memory analysis, network traffic analysis, log analysis, and automated correlation. The Service is provided on a subscription basis.
3. User Responsibilities
3.1. You must provide accurate information during registration.
3.2. You are responsible for maintaining the confidentiality of your account credentials.
3.3. You must use the Service in compliance with all applicable laws and regulations.
3.4. You may not use the Service for any illegal purpose or to violate the rights of others.
3.5. You are responsible for obtaining all necessary permissions and authorizations for any evidence you upload for analysis.
4. Evidence Handling
4.1. All evidence you upload to the Service remains your property.
4.2. You grant DreamGRC a limited license to process, analyze, and store your evidence for the purposes of providing the Service.
4.3. DreamGRC maintains strong evidence isolation between users and organizations to protect confidentiality.
4.4. DreamGRC implements security measures to protect your evidence while it is stored on our systems.
5. Compliance and Standards
5.1. The Service is designed to comply with digital forensics standards including NIST SP 800-86, ISO/IEC 27037:2012, and GDPR.
5.2. While DreamGRC strives to maintain compliance with these standards, it is your responsibility to ensure that your use of the Service satisfies your specific compliance requirements.
5.3. Reports generated by the Service are designed to be suitable for use in legal proceedings, but DreamGRC makes no guarantees regarding the admissibility of evidence or reports in any specific proceeding.
6. Subscription and Payment
6.1. Access to the Service requires a paid subscription.
6.2. Subscription fees are billed in advance on a monthly or annual basis.
6.3. All payments are processed through Stripe, subject to their terms of service.
6.4. Subscription fees are non-refundable except as required by law.
6.5. DreamGRC reserves the right to change subscription pricing with 30 days' notice.
7. Termination
7.1. You may cancel your subscription at any time through your account settings.
7.2. Upon cancellation, you will have access to the Service until the end of your current billing period.
7.3. DreamGRC may terminate or suspend your account immediately if you violate these Terms and Conditions.
7.4. Upon termination, you are responsible for downloading any evidence or reports you wish to retain, as they may be deleted from our systems.
8. Data Retention and Deletion
8.1. Evidence data is retained for the duration of your subscription plus 30 days after termination.
8.2. You may request deletion of specific evidence items at any time through the platform interface.
8.3. After the retention period expires, your data will be securely deleted from our systems.
9. Limitation of Liability
9.1. The Service is provided "as is" without warranties of any kind, either express or implied.
9.2. DreamGRC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
9.3. DreamGRC's total liability arising out of or related to these Terms shall not exceed the amount you paid for the Service in the six months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless DreamGRC and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.
11. Modifications to Terms
DreamGRC reserves the right to modify these Terms at any time. We will provide notice of significant changes by email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.
